Can custody rights be modified in Mississippi?

Yes, custody rights can be modified in Mississippi. There’s two ways to do that.

First off, and the more classic way, is that something has happened in the home of the custodial parent that is adverse to the health, safety, and well-being of the child and a change of custody would be in the best interest of the child, and always keeping what’s best for the child in mind.

Another circumstance would be that the visitation schedule as outlined in the original custody order is not working. For example, the father or the mother were awarded every other weekend visitation and one of the parties moved two states away. That then becomes impractical. Then the courts would rework a visitation schedule that would meet the needs of the parties and of the children in a circumstance like that.
