He may be able to do that. When I say may, if the property owner had noticed that there were such type of criminal activity in and around that apartment complex or apartment building and that by providing security they could have prevented that rape, then you may successfully bring a claim against them. They key is notice. If the property owner was on notice that these types of activities were going on, then they would have a duty to act.
