Can my spouse tell me that I cannot see my kids?

Lawfully a spouse cannot tell you that you can’t see your kids. Only a court can make that determination, and that determination is made by the analysis of what is in the best interest of the children.

It’s the presumption in Mississippi that children benefit from having a relationship with both parents. Both the mother and the father come into court in Mississippi with equal footing. And so, there is not presumption that a mom is better for a younger child or dad is better for a younger child, everybody is equal.

So, for a spouse to make the statement or the assertion that you can’t see your children, that actually might be held against them in court, because that might not be in the child’s best interest.
