It’s also known as a “tort.” The tort is an injury, for which the law provides a remedy. Typically people think of automobile accidents when most people think of personal injury actions. The typical auto accident, someone does something, or fails to do something in their vehicle, causing a crash, when injures another either bodily, damage to the vehicle, or both. The “at fault” driver is “negligent.” Therefore, you can collect money damages from that person equal to the damage caused.

Thus, if a person A were sitting dead still at a stop sign and person B hits persona A from behind, damaging person A’s car by $2000 and causes person A to seek medical treatment for another $2000, person A has a claim for $4000, plus any pain, suffering, lost earnings, loss of use of the vehicle, etc.

Torts reach far beyond claims stemming from car accidents. Negligence, or fault is the basis for liability in most personal injury lawsuits, including medical malpractice.
