What to Expect in Divorce Court

Divorce court: the room that no one plans for, but many married couples wind up in. It’s an intimidating place to be, as the judge sits across from you and signs off on decisions that that impact your parenting, your finances, and other aspects of your future. Notwithstanding the discomfort, your attorney can help to prepare you for your time in divorce court; there are several things you can do to make the experience smoother.

Show up on Time 

If you want to make an impression on the judge, aim for a positive impression by arriving a few minutes early. To begin, don’t be late. If you don’t make it on time, there is the possibility your former spouse will put forth a version of the facts that does not align with yours. Do you really want to let that testimony to be heard without refute? This day impacts your future: make it to the court on time.

Conducting Yourself in the Courtroom 

The way you handle yourself before the judge tells something about how you are. Handle yourself with decorum, avoiding offensive language, invectives, or diatribes. Think about your body language, as well. Eye rolling, fist pounding, head shaking, and annoyed sighs are signs of disrespect that you may be directing at your ex, but that will not reflect well on you. Show yourself to be a poised and reasonable individual who is respectful of both your ex and the court.

When asked questions, answer them frankly, sticking to the facts immediately related to what you’ve been asked without elaborate backstories or unrelated asides. It is important to demonstrate a respect for the court’s time and procedures. Listen carefully, and provided considered, courteous responses. At all costs, avoid interrupting. In the courtroom you may feel powerless and out of control, so it is imperative that you take control of circumstances in ways that you can. Choosing just the right wardrobe for court is an important way to express yourself before the judge. Here are some ideas to consider when picking attire for court:

  • Avoid flamboyant or ostentatious attire and instead opt for classic organization in the way you present yourself.
  • The price of the clothing is not nearly as important as the overall suggestion of neatness. You want to project stability and self-respect. Clean, pressed clothing does that, regardless of the label.
